Advice on applying of British Citizenship

Hi

One of my friend is EU national and he started exercising his treaty right since March 2009.
Last month he got is PR

He has two two children and he wants to apply for their British citizenship but he is confused about his UK born child will directly apply passport or first registration
Both child have PR

Child born in pakistan 08/2008
Child born in UK 05/2012

Please guide in detail

Neither child is British yet.

By PR I assume you mean both children have PR cards.

As s/he is settled, child #1 may register as a citizen at Home Secretary's discretion under section 3(1) of BNA when both parents are settled and naturalised/naturalising.

Child #2 did not have to be settled; child #2 may register as a citizen under section 1(3) of BNA now that one parent is settled.

Use form MN1 in both cases.

Once successfully registered, children may apply, individually, for British passports; (separate process).

Unless the friend has 'ceased activity', e.g. by retiring or being crippled, the second child cannot have got PR solely because of the father's exercising treaty rights. (That would happen in May 2017.)

If the child has received PR because of the mother's ceasing activity (possibly by dying), one must ask whether the mother was settled in the UK when the second child was born, e.g. by having achieved PR. If the mother was settled in the UK when the second child was born, then the second child is British and it is already eligible for a British passport.
