Change of circumstance AFTER visa has been granted

Post by kouchakudasai » Sun Sep 25, 2016 10:58 am

Hi there,

Apologies if I'm posting in the wrong place, I'm new to the forum.

My husband was currently granted a spouse visa enabling him to stay in the UK for another 2 years and 6 months. Previously he was here on a work permit and a post study visa before that.

Although my salary does now meet the criteria, I had recently changed jobs having started at a lower rate for training so we decided to use my husbands salary to meet the financial requirements when applying for his visa.

Now he has the new visa, he wants to change his job and start working freelance, meaning he would be responsible for sorting out his own taxes etc.
He's quite certain he can still meet the financial requirements in freelance work but my concern is, as his salary was the one used for the visa application, once HMRC find he's left his current company, can his visa be revoked/will this cause problems?

Sorry if this is a little vague. Let me know if you need more information.

Many thanks

I don't think that they would curtail his leave under these circumstances. However, he should make sure that he satisfies the requirements when the time comes for his extension.

If that is the case, does it mean once the visa is granted, financial circumstances become somewhat irrelevant?

Only in as much that as you've already been advised, the same income level must me met at the next application.
