Well then you have a fait accompli.

Seems like the father doesn't agree to let the child emigrate, you need to man up and sort it out yourself before bothering UKVI with it.

He is agree in divorce judgment he gave coustday to his wife and only judge said kids is minor this time so his father right resrev for claim coustday but if this will problem my wife will apply full coustday in court

Help guys.....my wife got again call from ukvi new Delhi for asked father contect number and my wife have them 2 number which her mom dad had and this is old number dont think so work but my wife told to that lady we have only this two number and it's not working and Lady said OK no worried just give us this number also my wife request you can see my all papers work and my son passport on his step father adress also his birth on my mom dad house my ex husband never seen him after my son born even he said he can't look after his and that's why court give me my son custody and Lady said we know everything we seen your application but entry clearance officer just ask me if you can get his biological father number ....so she said I will pass your ex husband number to officer .....and you will get decision and second my wife said I can't leve him India because he don't get feed without her....also she just came uk for 2 days for brp card and she gone back ...so what you think guys please let me know

Hi mate thanks for your reply just want to know if they can't talk with my wife ex husband then what is chance to get approval.....because on my step son all paper work and on his passport my adress in India he don't have nothing on his biological father address ......my wife have more then 2 and half year visa she just came here only 2 days so how long she can stay there ?

My wife have them number last Thursday but till now we not heard anything from ukvi but both number not in use so what we will expect from them because without my step son visa my wife can't come to stay uk anybody had experience please share thanks

Hi everyone today morning my wife again got call from British high commison new Delhi same lady asked my wife which number you gave us it's not working so I am just ringing to let you know my wife also said she know that it's not working ....so lady just no worry thanks .....but she don't ask anything like she don't ask any other number or any other way to speak my step son biological father .also my wife request to that lady you should understand my problem is can't leve my son in India and if you think my ex husband will claim coustday for my son in future for that I all ready send you one off my affidavit for all responsibilities she said OK.......so guys what you think about get approval for my 2 year step son visa ....we all ready provide his biological father affidavit with application please if anybody can advice

None of us can tell you what will happen. We don't work for UKVI or HO and anything we advise will be purely guess work. The clearly want to speak to the father.

You will just have to be patient and wait. Asking 'what we think' over and over again is not going to change anything.

Hello guys they did not accpet my wife ex husbend affidavit so they refuse again so I. Apply review for my step son application also I went to India to see family lawyer and told us you can apply only guardian ship which my wife to apply so did what our lawyer suggest us and he put all paper work from my wife side and also he wrote ression for apply guardian ship due to refuse visa for UK and hope so my wife will receive guardian ship within 40.days so after we can able to get Visa for my step son visa ?have you got any idea lawyer said when you will get guardian ship then you will be fully responsible for child future and kids can Stay with more all time and anywhere in the world

There will still be a record of the childs biological father and they will likely still require the details to speak to him.

You need to get the father to give up his parental responsibility through a family court or proper legal route.

Court already send him somone to appear in court for case hering and also they send him latter from court and also court write on this latter of you will not present in court by 10 June I will make my decision on that day also they make announcement on daily news pepper if any boday have objection they can come to court on 10 June so we doing by law and embassy can not chanleing to court order we already request to judge and he say guardian ship means you don't need any one person for anything for your kids you can take him anywhere to stay for whole life and he said you have already custody with you ....also my step son passport on my address in India without his father permission we send everything even refusal latter copy he will write on court order kids can join his mother in United kingdom for his better future ...his father don't care about anything he never seen him

Hello guys after 3 month today family court in India give full guardian ship for my step minor son to my wife ....So what you Think guys now about my step son Visa from India my wife been court in every hirring and she in India from last 3 month she have UK 3 year visa ..So my wife going to apply my step son Visa from India ...So how many chance you guys think to get approval ....in guardian ship court mentions minors child can go abroad for settlement with his morther and court mentions why we applied For guardian ship

No since my step son born he never seen him even my step son passport made without his father on my India stress ....and his biological father not interested on him court send him summon and also published in daily newspaper before approved guardian ship but no one came to court .....So my wife doing every thing for my step sson he only 2 year so court give all his future and welfare and about his study responsiblty to my wife

Due to the history of this case, you may well have to resolve this in a hearing.

If they did not believe the affidavit, they are essentially saying it is deceptive.

They may question other documents as well. You are therefore advised to file a notice of appeal against the previous decision, even if you are intending on making a new application.

We are going to apply 3rd time I don't want to appel it's take long time so I am Gona apply fresh application and also we will write covering latter about previous latter ....judge asked me my wife why we need guardian ship because you have custody off child when you ware divorced but my wife said court keep my ex husbend right rresoverd then he said ok after he said in his guardian ship order all rsspinsblty given to his mother for his better future and about his life so he can enjoy his life with his mother in abord ....also in guardian ship order judge mention about British high commission refusal so this is only document can provide in Indian law ....So also my wife keep all the proff as daily news peper and also summon photo copy which court send to my wife ex husbend and also all pepers work since we applied guardian ship

Hi everyone so finally after my wife got sole full gardiuan ship for her two year minor son in India she been waiting from last 3month court send my wife ex husbend recorded delivery later which we have proff he sign and racive but he did not appear in court and secound court published court hearing date in daily news with my wife name and also with address my wife to ask if anyone have objections about give gardiuan ship to abhaypartap please come to court this date it is was one month notice we also have proff as a news pepers .in final family court gave full guardian ship to my wife so she have UK visa but she live with my step son he only two month so can't live him alone....So guys please can you tell me sole guardian ship ok for apply step son visa court also mention In guardian ship order why we need full guardian ship the reason refuse my step son Visa before ....so anybody can share experiences please advice me ...also court mention in order minor father don't have any interest about minor

Hi guys I applied with my wife and my two year son settlement visa from India this aprail my wife visa granted but my step son Visa refuse the resion is my wife have my step son coustdy but my step son was minor on divorce time so judgment said I allow coustdy to mother but biological father right is revered .so embassy asked consent latter from father then we approached my wife ex husbend about consent latter he said I don't care about kids take him where ever you want and he make affidavit from his side and he told us don't bother me again we apply sencoud time and embassy called us we need father contect number my wife gave them which number she had so they try to called that number was not throw so again embassy called to my wife and said no one reply on that number so my wife said I have only this number of you want you have his address write him later but please try to understand without my son I can't go UK .and my step son passport on my address and we made without his father consent latter ...again secound time embassy refused due to not provide legal document ....so after my wife just came for two days alon to collect her biometric card from UK.then I went India and we went to lawyer and we told him our case and he said you can apply for full gurdianship and we applied guardian ship in May first week court send sunnon to my wife ex husbend which we have proff he singn and racived after court notice in publice news paper if anyone have objections for guardian ship can appear in court within month but no one came and after 3 month court allowed full guardian ship to my wife ...also in guardianship digree judgment said about embassy refusal and also they said his biological father no have interest about minor .... So we apply 3rd time today with guardian ship digree I also approch my local MP she gave me latter for sport my step son application ...also we attech news paper where court published news about gurdiuanship ...so guys please tell me what you think about my case now

Thanks for your quick reply ....my wife still in India since May ...so she applied today ...we are really worried she can't leve her son alon there .also in guardian ship judgment said petisoner can't leve her baby alon here because no one here for look after him .

My wife gave full gurdianship court order with my step son application so they will still need father consent latter ?sorry asking again but we are worried .in guardianship court order said minor biological father not have any interest on his son so that's why court appointed only mother full guardian for minor good study,future ,food to upbringing minor so she can enjoy her matrimonial life with her husbend in abroad ....So one else can look after for Minor in India only mother can look after him ....So guys any luck this time we had twice refused before we did not provide guardian ship before ...
