Extension on spouse visa lost passports by visa office

I'm a UK citizen and my wife a Indian citizen we have a child together who is also a UK citizen. My wife has a spouse visa which has come up for renewal this August 2016. We meet all the criteria's set by the spouse visa application as far as financial and both have jobs in the UK.

We applied for the spouse visa July 2016 and sent all relavant documents along with application form and both our passports ( luckily I decided not to send my child's passport but only a photocopy as I thought it wasn't nessesary sending the original) All documents rechecked from our solicitors.

We received a letter stating that the passports have not been received and we had to supply the Passports along with a missing signature namely mine on the form as well as a biometric within ten days. Thinking that they may have misplaced the passports we sent the biometric.

After my wife's visa had expired they had sent a letter along with our documents, a cheque and no passports saying that she has to leave. Which was in September 2016.

We have notified the solicitor, who has sent the documents back with a letter in September 2016. We had also contacted our local MP who has also sent a letter. None of which has helped as it has been 2 weeks.

My wife had called the call centre number of occasions to enquire but was told rudely that only the case worker can deal with it.

I have now paid for a new British passport cost £80 as I'm thinking that it has been lost by the visa office in Sheffield.

During this period my wife has to report to an office in London every 2 weeks which had also been stated in the letter. Upon our arrival for our first visit the lady at the desk has said that she can come every 2 months instead of two weeks as we have a child together. She had checked her data base of which one British and one Indian passport has been found and kept in a safe ( her words were: they have been sent and kept in a secure safe... Although everything was sent together). No news on the documents we sent ( had all her original certificates)

At this point I'm not sure what to do. Wether I should take the matter to court proceedings as she not allowed to work and she would lose her job ( claim of loss of earnings) as they had lost the passports as well as losing mine ( cost of renewal of my passport) would I make a formal complaint? Do I go to the press? Why haven't they contacted me to say they have my passports before I filed them lost.

What should I do next?

My solicitor has adviced me to wait for a reply but I'm thinking as it has been 2 weeks should I be exploring other avenues as it has been a month since her spouse visa has expired?

Ask your solicitor for their opinion on applying for an Administrative Review, due to the Case Worker's error. However, you may already be out of time for this.

Thanks for your reply, but like you have mentioned I maybe already out of time. I have spoken to my solicitor and although through his advice I have sent the form back with our documents with a letter stating to reconsider due to their mishap and mine it seems to over look this. Unfortunately it has been two weeks and no reply.

My solicitor has said to come in think about taking it to court as well as seeking other option. I may phone other solicitors asking their advice for a second opinion.

Does anyone know how much it is to take the case to court and also the time it will take to resolve or wether if there's any other way
