Flr (fp) fee waiver rejected. Now what?

Hi everyone. Around feburary my partner applied for an flr (fp) application along with a fee waiver. I am due to have our baby next week and he just got a letter to say it has been rejected and that we need to seek legal advice urgently and submit a fresh application because they are now liable to remove him from the uk and take him back to india.
We haven't got money for the HO fees at the min and with me due having our baby I'm worried they are going to take him before I have him and before we get ourselves together to submit an application!! Can they still take him?
