De facto after judicial separation

Hi
I am german citizen living in ireland i was previously married to someone then i got judicial separation.
During the process of separation i met my boyfriend who is non eu.now we have lived together for 2 years together.can he apply for de facto resident permit.we cant married because i need to wait 5 years before divorce.
