Intra Company transfer question

Post by anky86 » Fri Oct 14, 2016 12:32 am

Dear forum members,

I am relatively new here and had a question regarding intra company transfer and was wondering if you could point me in the right direction. I am currently working in Australia. I started working with a company A in Nov 2015. The business unit was sold to company B and we were all transferred to company B in April 2016. It was sold in Dec 2015 but there was a transition period. Now the company B wants me to go to UK but there is a requirement of 12 months. I was wondering will the company A work will count towards 12 months. I have the same role under the same management and in the same building. Hope someone can answer my query.
Thanks

You will have to show the entire history for the preceding 12 months to demonstrate the 12 months of employment within essentially the same business. BUT be aware the documents will have to legally substantial and fully demonstrate the transfers between the two separate companies and you will also have to supply secondary evidence of previous employment and continuing employment. Payslips, transfer letters, employment contracts etc.
