Is appeal to the Tribunal allowed?

Post by jafersadeq » Fri Oct 14, 2016 2:18 pm

Dear Gurus,

I wonder about this case: if the HO refused the first extension application and the applicant knows that AR is useless, and if he applies the second application he knows that section 3C does not cover the period from the application date to the decision date. My question is:
Can he appeal to the Tribunal on the 14 days after the refusal. If yes, does the section 3C cover the period from his appeal to the decision?

Thanks

Have you missed the memo in 2014 ?? Immigrants have NO right to appeal in the UK since Immigration Act 2014 came into force. Your only option is JR at your own expense and risk

Many thanks for your answer,
If some one applies 2 months before the visa expiry date (after completing 3 years, he has 2 months before expiry date), and the result appeared after one month of his application, the result is refusal, he has one month to his visa expiry date, if he decided to apply new application in that month... Does section 3C cover the period from the date of the new application to (let's say 3 months after the expiry date)?
Kind regards,

Yes, section 3C will cover you after your visa expires if you applied while you had a valid visa
