hello , any advice will be very welcome. my wife (african) came to the uk 10 years ago to live with me (british) about a year later we sent for her 8 year old son his visa was granted and he came to the uk , i looked at his visa and it said "indefinite leave to enter" so he has had this visa for the last 9 years, my wife has now become a british citizen and we want to register her son as british, my querie is this. do we have to upgrade his visa to "indefinite leave to remain" before we try to register him as british

No. Indefinite Leave to Enter is the same as Indefinite Leave to Remain.

ILE is issued outside of the UK
ILR is issued within the UK
(Casa, not CR001)

does anyone know what category he would be applying under, also what we do about his fathers consent, his father can not be found in africa and could be anywhere

Section 3(1) of BNA - at Home Secretary's discretion.

Don't worry about lack of contact/support and consent from absent parent; just explain it all in cogent cover letter.
