I'm an EU member who has arrived in Paris, France with my wife and stepson.

All my paperwork is in order to apply for residence and my wife received her receppisse on application. However, in France, they do not give a Carte de Sejour to under 18s (my stepson is 15)

I then went to apply for a 'circulation transfrontiere' but was told several times by several people that as my son is not my birth son, he could not apply as an EU family member. On the fifth attempt, they decided he could apply, but that my son would have to wait until my wife has her 'carte de sejour' until he can apply.

My wife's date for her 'convocation' is in June 2017, leaving my son in no-man's land until then.

Has anyone had experience in this situation? Is it correct that my son must wait until my wife has her 'carte de sejour' before he can apply? Any ideas on how to persuade the French authorities to accept an application now?

Solvit are (hopefully) on the case, but any first-hand experience or advice from the knowledgeable will be very gratefully received.

I am also living in France Paris as a family member of British citizen,
Could you please tell me when you applied for your wife carte de sejour and which date they gave you for the convocation ??

Hi Umairks,

Yes, I'm not a frequent poster...

I originally applied for the Carte de Sejour for my wife in October 2016. We were given an original convocation date in June 2017.

I wrote to the Prefecture, quoting a passage from EU law that says they have to provide an answer within 6 months of application. They then sent a new convocation date in November. :D

At the convocation meeting the lady we saw wasn't happy with our paperwork and gave us a new convocation date in March :( We were also asked for some more documents, including social security for both of us (despite her not being eligible!)

They accepted our papers at the March convocation, saying that we would receive the card within 2 months. Still waiting...

Anyway, some advice:
Try quoting the law I mentioned above to push the convocation earlier.
Get lots of papers ready and give them everything.
Bring a French person to deal with the staff at the prefecture. (unless your French is amazing!)

Hi Umairks,

Yes, we did.

Interestingly, we went to the Prefecture in early May to ask if there was any news. The lady at the desk where we applied for the Carte de Sejour checked on the system and said it might be ready. We then lined up at another desk and got the Carte de Sejour that day.

Two weeks later we received a text message saying that the Carte de Sejour was ready...

Once we had the Carte de Sejour we applied for the Document de Circulation for my son. They were very unsure whether they could give this (they still believed that as I was only the step-father, he couldn't be given one of these if he had come into France on a C Shengen Visa) but accepted the papers anyway and gave us a date to return.

When we returned, the boss was there - she checked our papers and an hour later we got his card - valid until the day before he turns 18.

So, all is now good. I've now applied for a Carte de Sejour too (worried about Brexit) and will have the meeting for that in November.

I hope all is looking good for you (and all other frantic seekers of their Carte de Sejour.
