Being on matrinity leave = exercising treat rights?

Hi guys,

Thanks in advance for your time.

If a woman (EEA national) is full time employed in the UK and then takes maternity leave, is she still exercising treaty rights? As you know, in general maternity leave is paid for 9 months of a total 12 months and the remaining 3 months are usually unpaid. Is she exercising treating for the 12 months, 9 months or not at all you think?
