Switch from Tier 2 ICT dependent visa to Tier 2 General visa

Hi,

My enquiry is to find out if there is a settlement option via Tier 2 ICT dependent to Tier 2 General visa conversion route.

My UK visas:
17/06/2010 - 30/07/2011: Tier 2 (ICT) Established staff (Left UK on 06/05/11)
08/05/2012- 29/05/2015: Tier 2 ICT Long term staff migrant (came back to UK 27/05/2012 & staying since)
05/06/2015- 21/05/2017: T2 ICT Long Term Leave to Remain (restricted work)

My wife's UK visas:
18/03/2011 - 30/07/2011: Tier 2 PARTNER (dependent on my visa) (Left UK on 06/05/11)
08/05/2012- 29/05/2015: Tie 2 ICT Long term staff partner (dependent on my visa) - (came back to UK 27/05/2012 & staying since)
05/06/2015- 21/05/2017: T2 ICT Partner Long Term Leave to Remain

My wife's employer is willing to sponsor her a Tier 2 General visa. She is now planning to go to India to get her visa converted to Tier 2 General (mostly before end of this year) & will be on maternity leave from July-Dec 2016. After she comes back to UK in Dec 2016, I will apply for conversion of my Visa to Tier 2 General dependent. We both should then be having Tier 2 General Visas say from Nov 2016.

Will we, after our converting into Tier 2 General category be eligible to:
1. Continue work in UK beyond 21/05/2017? If so, what is the maximum time until which we could stay?
2. Can we under any provisions be eligible to apply for ILR & subsequently citizenship after 6 years of continuous stay?
3. Will the continuous period for ILR (if we are eligible), start from the day we get our Tier 2 General OR from 27/05/2012?)


Appreciate this is a quite a complex situation, but will really be grateful if you could kindly answer the above 3 questions.

2. Can we under any provisions be eligible to apply for ILR & subsequently citizenship after 6 years of continuous stay? Tier 2 General allows you to apply for ILR after 5 years continous stay provided you meet other eligibility conditions at the time.
3. Will the continuous period for ILR (if we are eligible), start from the day we get our Tier 2 General OR from 27/05/2012?)Switch from PBS dependent to Tier 2 General will reset the clock so ILR time accumulation should be assumed from the new leave date.

Dependent Visa

Here is my situation, a little complex I would think:

I am on a Tier 2 ICT Long term visa expiring in May2017 living in UK. My wife is a dependant on this visa however is in the process of switching to a Tier 2 General visa (she got an offer from a UK company, rlmt etc done, sponsorship obtained, applied for visa and submitted her passport docs at Visa office in India)

Now we also have a new born baby who is currently in India with my wife. We need to apply for her dependant visa. There are two options and want to know if there are any special requirements we need to be aware of and also help to decide which option is best.

Option 1: Apply as my dependant on Tier 2 ICT
Option 2: Apply as my wife's dependant on Tier 2 General

We need the visa on an urgent basis as my wife needs to travel to UK to report to work (by mid nov).

Option1: Does she need to wait until her Passport arrives with her new visa for us to apply? As my company is not wiling to give a sponsorship letter until they see my wife's new visa.

Option2: Can we kick start the process while my wife's visa is still in process (as her passport etc arent with her)? There is still uncertainity over by when they will give us the visa as they requested for NARIC letter etc, which we arranging. However, if we start off the process early, there are good chances that both visas would be processed by mid Nov?

Option2: Would the home office need any document from me stating that I am in UK and hence wouldnt be with my baby for the visa process etc?

Any help will be much appreciated.
