PR for Student/worker - Parent in UK - Unusual case, Urgent

Post by georgen » Sun Oct 23, 2016 11:58 am

Hi All,
First of all, I’d like to mention that I have read quiet a lot of posts here and haven’t found a concrete answer hence why I’ve decided to open a new thread. I will explain my case below and be as detailed as possible.
I want to apply for PR but at the moment I am not sure which route to take, and I suppose there could really only be one route, so here is my case below.
I came to the UK on the 26th Sept 2011 to study on an undergraduate degree (22 years old).
Father came end of October the same year and started working for an agency early November, his work varied between 14-26 hours.
Between December 2012 and March 2013 I was doing part time work 8-10 hours a week, at which time my sisters and mother also joined us (mother has 5-year residence permit from my father as a non-eea family member).
June 2013 – June 2014 was my sandwich year and I worked for a big company in a different city, at the university I was still registered as living with my father and the term-time only address was in wales, which was where my paid internship was (£14k for the whole year).
I came back after that year and moved back in with my family from June 2014-2015. Before graduating I setup my own Ltd company which started trading July 2015. In October 2015 my father joined the company and took over as I found a job based on my Degree, although I am still down as a Director but not on the payroll anymore.
Since Oct 2015 I have been working full time for a company and during this time I have moved out and live with my partner where we rent etc.
My father is due to apply for PR at the start of next year and I was wondering what are the chances that I could be included in his application? He has changed jobs but there transition period has been a few days so this shouldn't effect him.
I understand that my student years cannot be used if I apply on my own as a student as I did not have a EHIC or CSI. However, considering that I was living with my father during my student years will I be able to apply with him?
I read somewhere that if I am above the age of 21 then the sponsor has to show that I relied on them financially. I have checked my bank statements as far as I can online but this did not cover 2011-2013.I remember my father giving me cash here and there and I deposited this into my bank account, there might have been a few instances where he transferred from his own account to mine but these are very few.
When I first came here he transferred around £14k into my bank account which was sort of emergency money, I do not recall using that money as he either gave me money or I had my own from when I was working or from my savings.
So I suppose my question is whether I have any chances of getting PR the same time as my father, considering that my father won’t have an issue getting his PR and there are no hiccups in his case.
Also if I do not meet the requirements, but my father does, what happens to the application? Does it get refused overall or do they just give my father PR and not me. I do not want to cause any issues for him so if it’s best I don’t apply with him then so be it.

Will the 14k that my father first gave me show that I relied on him financially, even though I don’t recall using that money?
We both do not have a registration certificate as at the time we did not know about it and did not think that it was necessary.

I look forward to your replies

Thanks,
G

Over 21 you need proof of dependency on sponsor for essential daily needs. In HO terms a papertrail is required.

If a selfsufficient qualified person at any period (eg living on 14K lump sum) you need to have held CSI.

Whoever applies, HO may apply its MET/PET test over and above the EU 'genuine and effective' test for a worker/selfemployed.

You may still apply separately (separate forms) even if father is sponsor.
All that is gold does not glitter; Not all those who wander are lost. E&OE.

Hi Nojthan,

Thank you for your reply.

Are you basically saying that my father work even if he applies on his own may be scrutinized because 16-24 hours may not be sufficient?

Thanks,
G
