Do I have adverse immigration history?

Post by GSmith1985 » Mon Oct 24, 2016 7:10 pm

Hi everyone,

Assuming everything goes well this next cycle and I am issued the restricted COS that my company has applied for, I should be submitting an application for a Tier 2 General visa sometime next month.

I'm a bit concerned about a warning stamp I got in my passport recently, though. This year, I spent 4 months visiting the UK before heading to Germany for another 3. On my way back to the US in September, I stopped for 2 weeks in the UK. The immigration officer was concerned that I had spent 7 months in Europe, took down my details, stepped away for a while, made a call to the contact I was staying with in the UK, then returned and let me through. However, I got one of those warning stamps with "6 months" written by hand and what I assume is a case number on top.

Does this count as adverse immigration history? I was never really clear whether he had considered me an overstayer. As far as I knew, I was allowed 180 days in the UK and 90 days in Europe and that those were separate, but he seemed to count those together.

Any advice is greatly appreciated!

Thanks :)

You don't have an adverse history, all the Border Officer did was to mark your passport to show that you had already stayed in the U.K. For a noted period.
Essentially it is a don't stay beyond 180 days in a year marker. It just makes it obvious your stay at the time you returned was flagged up if you left and returned again.
Don't sweat it :D

Ah okay thank you Frontier Mole! Since it happened I've been kicking myself for not actually asking him what the stamp meant, so appreciate the insight :D
