UK NIN and Benefits for elderly mother who got ILE

Post by mrkhurana » Wed Nov 02, 2016 3:28 pm

Moderators,

Need help regarding National Insurance application and Benefits eligibility. My mother is dependent on me and got ILE (Indefinite Leave to Enter) visa from India. She is 74 now. I am a British Passport holder.

Following are the visa details:
ILE Visa Issued on 14/Nov/2011
ILE visa valid till 20/Mar/2012
Entered UK on 30/Jan/2012
Based on above dates she is qualifying for UK Citizenship on 30/Jan/2012

Based on the above information, is she eligible for any benefits in UK (before/after citizenship) and when can we apply for her national insurance number application?

Note: She is not claiming any benefits as we don't know UK laws enough hence don't want to do anything illegal and jeopardize her citizenship

Any help will be appreciated.

Best Regards

"E- ECDR.3.2. If the applicant’s sponsor is a British Citizen or settled in the UK, the
applicant must provide an undertaking signed by the sponsor confirming that the
applicant will have no recourse to public funds, and that the sponsor will be
responsible for their maintenance, accommodation and care, for a period of 5 years
from the date the applicant enters the UK if they are granted indefinite leave to enter
.

I doubt that your mother needs a NI number. She won't be entitled to a state pension due to not paying into the system for the required minimum of 10 years.

Thanks Casa for your prompt reply.

I think I have also signed the undertaking with her initial ILE application. Hence we are are not claiming any benefits as not sure. I even didn't applied for her National Insurance Number just to be safe (because we need to have NI in order to claim any benefits)

Do you think we should apply for her national insurance number at least before applying for her citizenship or can that have an negative impact on her application as well?

Best regards
Manpreet

The free TV licence is for over 75s, not 65.

A NI number isn't necessarily required.

"If you're completing a free over 75 licence application, just tick the box which says that you don't have a National Insurance number".
