Wife's EEA4 application & JSA

Post by dilberg » Wed Nov 02, 2016 8:49 pm

Hi,

I am an EEA national with Permanent Residence, I am in the process of a restructure at my employment, and will possibly be made redundant, with redundancy payment. My wife is a non-EEA national with RC for 5 years. She is not working and I will be her sponsor when she applies for PR after 4 years. I have private CSI for her with Aviva.

For my wife to exercise treaty rights as self sufficient for the time I am out of work would it be problem if I were to register with Jobcentre and get Jobseeker's allowance, & other benefits. I would like to know if her Self sufficieny status would be affected if I were to get JSA as I am also her sponsor.

Thanks.

Wife cannot exercise treaty rights in her own right, her activity is immaterial.

You are her sponsor and have to sponsor your dependent spouse.
If you have already acquired the holy grail of PR then it is immaterial whether you are working or not.

RC is not really relevant; how long have you been married, how long have both been in UK and when did you start exercising treaty rights?
That determines when wife may acquire PR.
All that is gold does not glitter; Not all those who wander are lost. E&OE.
