How long will i wait

I done my biometrics on 10 August 2016 and i have been waiting since then .Anyone with an idea how long it takes

Do you mean a Spouse Settlement visa? If so, where did you submit the application?

Yes thats the one submitted through my lawyer it went to Sheffield Uk

I am in the Uk mate any idea of the time scale .Or will i get refused after i done the biometrics.

Biometrics are only the first stage, before the Case Worker even begins to assess the application.

What category of spouse settlement visa have you applied for? FLR(M) :?:

What is your current immigration status? i.e Do you have a valid visa at present?

FLR is the one i applied i am on a visitors at the moment which is about to expire end of next month . Thank you

Then you have a serious problem. :!: Your 'solicitor' should have advised you that it's not permitted to switch to any other category of visa (including a spouse visa) from within the UK while here on a visitor visa.

The application stands zero chance of being approved. Also the Statement of Changes published by the Home Office yesterday, give notification that from the 1st December no appeals can be submitted from within the UK, only from the home country.

Unbelievable that a legal professional could not only submit an application that they must know will be refused and obviously charge you a fee for doing so. :!:

You should ditch your solicitor immediately. They have made a schoolboy error here!

You can apply to extend or switch in any of these routes if you’re eligible, except if you have permission to be in the UK:

as a visitor
As Casa has pointed out you have just wasted your money as you cannot switch visa categories if you are in the UK as a visitor. Your application will almost certainly be refused :?

Also, if you're still reading these posts (please don't shoot the messenger), the fact that you've declared your intention to settle in the UK will now have closed the door for visitor visas in the future. :!:

I doubt that the Home Office will return your passport as the current policy is to retain this until you have given a confirmed date on when you will be leaving the UK.

Passports in this case are generally handed over by the Immigration Officer at the airport on departure.

Is your legal advisor registered with the OISC or if a Solicitor, a member of the Law Society? If so you may have grounds for compensation.

Another case of cowboy lawyers as my partner calls it.

If you're legally married the best option would have been for you to return home without over staying then apply to settle with your spouse. You've already spent so much money with a lawyer, a quick post here would have been your best option.

In addition: flr applications have a massive backlog at the moment as I have been chasing my own case (will post in timeline as soon as we give biometrics)

So sit tight for the response and keep on top of your lawyer for any reaponses.
