Expiration of Visa while applying for a residence card

Hi Guys.

My demand is quite urgent so sorry if this question is already mentioned in the forum.

I am German and my wife (is from north Africa) applied for a EEA family member and she is here since August. I want to apply for the residence card. My wife Visa is till the 17th of January 2017. I have really many questions:

1. will my wife break any law if we didn t get any respond from the Office after the 17th of January.
2. If we get a refusal before the 17th of January, can we still apply for a second time for the residence card.
3. I just read this part:

You don’t need to apply for a residence card as a family member but it can:

help you re-enter the country more quickly and easily if you travel abroad
show employers you’re allowed to work in the UK
help prove you qualify for certain benefits and services
You must apply for a residence card or have a valid EEA family permit if you’re an extended family member.

is this something to do with my case.
4. The Home Office has decided to bring new laws from 25-11-2016. should I apply after this date or do it right now. I have all my documentation ready to send.

1) No, assuming you are a qualified person

2) Yes

3) Yes, the RC is optional (but useful); wife is permitted to resie/work/study in UK by virtue of you being a qualified person (exercising treaty rights).
A RC simply confirms this - it doesn't grant the rights.

4) Apply when ready with all evidence.
