Hello everyone I am non EU family member married on 11 April 2013 we were both together for about year and half then she call police on me on false allegation so ive been issued police caution from that day onwards we didnt live together anymore so now its been 3 years we are living legally married but dont live together i dont even know her whereabouts I am planning to apply for a divorce , btw ive been issued residence card on 23 oct 2013 which will expire on oct 2018 , she acquired permanent residence as she was in UK since 2008 , and she was self employed after our marriage we been interviewed before i got my residence card by HO and we passed with no problems now i want to apply for divorce and get to ROR , can i travel outside while my divorcing is pending will i get difficulties coming back and for ROR i only have her accountant letter and copy of her passport and i think do i need to prove she was a qualified person as she already has permanent residence please advise much appreciated.

In the absence of proof that your wife is in the UK, it will be unsafe to travel, especially with new laws on verification coming on board soon.

How about the police matter. You said you have accountant papers for her, do you have bank account and evidence she is doing activity.

Even if she has PR, if she had it over 2 years ago, you will need to demonstrate that she had not been out of the UK for more than 2 years during that period.

hi obie , ive just been cautioned by police it was just the warning , i dont have any bank statements of her that she is receiving payments or anything , i thought it was alright to travel as divorce will be pending so they cant refuse entry thats what i though , and she is still in UK for now i guess as i spoke to her on facebook she said to me catch me if u can

Why the need for urgent travel? You can go if you like. You are under no obligation to take my advise.

thanks obie , its just some family issues thats why i was thinking for travelling , please advise as to what is the best thing to do for me

If you got to go then you got to go and upon return deal with any issue that arises.
