Switching from Tier 1 (Entrepreneur) to Tier 2 (General)

Hi All,

I have two questions:
-------------------------

1) I would like to know if it is possible to switch from Tier1 (Entrepreneur) to Tier 2 (General), if I have a sponsor?

2) What categories we can 'switch to' if on Tier 1 (Entrepreneur). Is it possible to switch from Tier1 (Entrepreneur) to any other Tier (category) at all ?

Yes but the sponsor will have to conduct a genuine RLMT

2) What categories we can 'switch to' if on Tier 1 (Entrepreneur). Is it possible to switch from Tier1 (Entrepreneur) to any other Tier (category) at all ?
You can only switch to Tier 2 if you are currently on Tier 1 Ent visa.

Hi aby00156, Do you know what happens with 5 Yr ILR route? Does the person switching need to wait for another 5 Years after switch? or does the time spent on Tier1 (Ent) count towards 5 Yr ILR ?

You can combine Tier 1 Ent and Tier 2 General for 5 years ILR if you are on tier 2 General while applying for ILR

Just wondering if we can still switch if your Tier 1 visa is expired and you got rejection for extension application?

In such a case there would not appear to be a visa to switch from.

Can I ask just another doubt relating to this topic?

If your Tier 1 visa is rejected and you have to go back to your country. If you then apply for Tier 2 visa and get it and come back.
Can you still count the time spent before leaving UK for long residency condition?
Eg. if you have spend 8 yrs in UK and go back to your country and come back in few months on Tier 2, can you count 8 years towards long residency?

Technically you can leave and come back with a new visa but the acceptable gap without a visa is currently 28 days only (soon to be reduced to 14 days)
Any more gaps means that your continuous period of stay will be broken and you have to start over.
