Residence Card (EFM - same-sex unmarried partner)

Dear community,

I will send next week my application to a Residence Card as a same-sex unmarried partner of a EU National (holding a Residence Card). I'm a Brazilian citizen currently in the UK.

We gathared a good bunch of documentation, like letters from friends, WhatsApp screenshots, bank statements, birthday/christmas cards, cover letters, etc.

For those with a similar experience, how long it usually takes for a "final" decision from Home Office?
Do I have the right of work while the application is running?

PS: I couldn't find much information in the forum regarding my case. Sorry for being repetitive.

Do you have a valid FP or RC at the moment?
if not you will not be granted a COA confirming right to work (as you are an EFM).
You will need to wait for a successful grant of EFM RC.

Takes several months. You can monitor others' experiences in timeline thread. Your mileage may vary ofcourse.

No, I don't.
Thanks for letting me know. I don't know the "approval rate" of RCs in the UK but I believe my application is fairly good and I hope it works.

How long have you been living together in a durable relationship akin to marriage for at least 2 years with the documented evidence to support this?

WhatsApp, references from friends and cover letters won't count for much with the Case Worker.

You need proof of joint commitments such as shared finances, joint tenancy or mortgage, both names on utility bills etc, and co-habitation for the mandatory 24 month period.

A durable relationship is not just a boyfriend/girlfriend visa. It is more a relationship akin to marriage visa and there is an expectation that the two of you have lived together as a couple for a period of time. That is the proof that the caseworker will look for, not pictures together or letters from friends and family.

Are you here on a visitor visa? If you are, remember not to overstay your visa. Submitting an EEA EFM RC application does not give you legal stay in the UK. Any overstay of the visit visa may cause issues further down the line.
