Can a tier 2 work permit holder open a limited company

Hello

I am a radiographer and i work for NHS on sponsorship Tier-2 visa. I would like to do some extra work as a secondary job where i work 20 hours for an agency of the same profession and i have a limited company where the salary of my second job goes into and my company is registered in the HMRC under business account. Now i am under a suspicion as one of my friends suggested that i cannot own a limited company as long as i am on a tier 2 work permit. But my accounting firm and my accountant think is is okay to have a limited company.

I am so very confused. Can you please advise if it a serious crime for me to do so. I am very nervous and restless.

Tier 2 migrants are not allowed self-employment so you are indeed in breach of your visa conditions. Presuming that the agency is paying your company B2B instead of paying you via PAYE.
