EEA (PR) application CSI for complete student period?

Hi,

My wife is an EEA national looking to apply for permanent residence (PR) based on 4 year (student) plus 1 year (working). Her student period starts from October 2011 to Sep 2015. She got the Comprehensive Sickness Insurance (CSI) in April 2013 and was able to obtain a yellow card (student) on that basis. She kept the CSI till 2016 when she already started working. Now for the 2011 to 2013 period when she did not had CSI. Is that an issue that one needs to be concerned for PR application? If so, how can it be addressed?

Unless the residence card was granted to her as a student before 20 June 2011 or unless she had a non-UK EHIC whilst she did not have CSI, Oct 2011 - April 2013 won't count towards her qualifying period for PR. Her qualifying period would begin once she obtained CSI.


If she didn't either have the residence card (issued before 20/06/11) or a non-UK EHIC, there is no way to rectify this now and she will only qualify for PR in April 2018 provided she remains a qualified person until then.


Are you an EEA national too? If so, what were you doing from 2011-2013? If you were exercising treaty rights and you were married back then, she may be able to use you as a sponsor.

I think it is as you mentioned that she might have to wait till April 2018.
