Tier 2 General

Please can someone advise

My friend has a Tier 2 (G) visa from last 2 years. The MD now wants to transfer him to his new company which e has recently taken over. What I am confuse

1. New Company has to apply a new Sponsor licence ?
2. Can my friend relocate after applying a new visa ?
3. RLMT is required ?
4. Will it be still Tier 2 General or it will be Tier 2 (ICT) as this new company will be as T/A
4. 5 year cycle will be broken ?

1. New Company has to apply a new Sponsor licence ? YES, THEY DO
2. Can my friend relocate after applying a new visa ? Not yet, the visa needs to be approved before he changes, as he would with any new employer.
3. RLMT is required ? YES, unless his job is in the shortage occupation list. The tricky bit here is to prove how they seriously and fairly considered settled (UK or EU) workers as a first option before employing him, because it seems he will be pre-selected for the job, so you might want to consult with an immigration lawyer on how to conduct this fairly. If there is anyone from Europe suitable for the job WHO APPLIES, they'd have to employ them before making him an offer.
4. Will it be still Tier 2 General or it will be Tier 2 (ICT) as this new company will be as T/A. It's a brand new Tier 2 general. ICT is only if he works for a company overseas and that same company sends him here.
4. 5 year cycle will be broken ? If he applies in-country before his current visa expires and the switch is successful, it will NOT break the 5 year cycle
