I've always read the forum for previous questions I had, but this time my question is so specific that I thought it might be worth talking to you guys, as I can't find much information regarding this matter.
I'm a Non-EEA citizen working for an Irish company in Dublin since May 2015, I hold the critical skills work permit in Ireland valid until 2018. However, it's more convenient for the company (and also for me, for personal reasons) to be relocated to the UK. The company has recently got a registered number in the UK and we understand that getting the sponsorship license and certificate can take a long time - if the license is granted at all!
But an interesting thing is happening right now... Our company is in the process of being acquired by an American group, which also bought some British companies. One of these British companies holds a license for sponsoring Tier 2 visas. The American company is buying all these businesses but acting more like an investor, which means they're not planning to make major changes in structures - we all get to keep our registered numbers in the UK, companies' names and brands will remain the same, etc. The only thing that changes is that we're all part of a group now, having the same owner.
This made me think if it's possible to be sponsored by the company that has the license, but keep working for my currently employer, only in the UK. Let's call my employer A and the British company with the license is B... Can B sponsor me to work for A in the UK, as both companies belong to the same owner?
I read the following copy on a website and it made me think it might be possible somehow?
"It is also worth bearing in mind that a UK entity within a group linked by common ownership could be the Tier 2 or 5 sponsor of non-EEA migrants who are actually employed by another named UK entity in the group."
Is that possible at all? If not, is there any other route you'd suggest us?
