Confusion

Please can some one advise. I have colleague who works with me and on Tier 2 visa expiring Oct 2017

we both work in main office but company has another office with different name in London. My MD wants to move him to that place. All I need to know

That our Tier 2 licence is only for Northampton branch

1. does new branch need a new licences and or can be added to existing Northampton branch
2. can my colleague can go and start working there or does he need to apply new visa. The reason the current visa as per the assigned COS is to work for Northampton so will he need new visa and New COS can be generated
3. if this is the case. does the same employer needs to do RLMT for London branch although it is just the internal shifting
4. if he needs new Visa, this means experienced salary to be offered

Really confuse that its new branch with same company with different name.
its is not mentioned on Tier 2 sponsors .

Employer has to do RLMT
internal shifting to different branches is not allowed in Tier 2 General ?

The issues you raise are primarily the employer's responsibility, not your friend's. Ask him to contact the HR department.

HR doesnot know anything and every time they get different answers from HO

if you can help , please advise

If the MD wants to transfer your colleague to a different branch s/he should tell HR to get their act together. If the rules are breached the company's sponsor licence may be in jeopardy and they may be fined up to £20k for employing an illegal worker.

HR should ring the employer helpline 0300 123 4699 - it is unlikely that they get different answers to the same question. They should also read the Tier 2 sponsor guidance (link above).

If HR are completely inept they should seek advice from an immigration solicitor.
