I'm non-EEA national so i think i required as well but not sure about it my wife she is British born some people say i can travel some say i need visit visa can't decide which one to believeSAtoIE wrote:Where are you from? Above, there is no mention of having to fulfill the requirements of Singh for a spouse to have a right of entry into one's own member state.... a Member State may not send back at the border a third country national who is married to a national of a Member State and attempts to enter its territory without being in possession of a valid identity card or passport or, if necessary, a visa, where he is able to prove his identity and the conjugal ties and there is no evidence to establish that he represents a risk to the requirements of public policy, public security or public health within the meaning of Article 10 of Directive 68/360 and Article 8 of Directive 73/148.

What is the criteria for fulfilling the requirements of Singh at a port of entry? Is it 3 months residence under article 6 of the directive, or 3 months under article 7? Does anyone really have a clear answer on this?
