RoA application outside UK for baby born in UK for ILR fathe

RoA application outside UK for baby born in UK for ILR fathe

Dear All,

May I get your advice on a my scenario to apply for Right of Abode (CoE) application from Chennai (India) for baby born in UK for an ILR father.

I had my ILR for more than a year when my son was born couple of months back. I had applied for 'Indian' passport for my son by choice to retain Indian citizenship & upon research to apply for dependent visa options got to know about this 'Right of Abode' certification & eligibility criteria stating baby born in UK after 1983 / 2002 who has a parent with ILR is fine to proceed for CoE. As I learnt that the processing time to get RoA certificate from UK might take more than 3 months or so, I need your advice / help with regards to the possibility of applying 'RoA' application from India / outside UK due to an emergency situation for whole of our family to travel urgently to India in couple of weeks time.

May I know if any one with my scenario of baby born in UK for an ILR father had applied for 'RoA (CoE)' from India / outside UK successfully, Please. As per the online application for those who ' apply for RoA from outside UK', I couldn't find any option mentioning 'ILR father with baby born in UK' under Right of Abode section. Herewith, I have also pasted the options from the online application as below for advice,

How do you qualify for right of abode?

* Born in the UK before 01 Jan 1983*

* Born in the UK after 01 Jan 1983*

* Adopted in the UK*

* Registered or naturalised as a British Subject, citizen of the UK and Colonies in the UK on or after 01 Jan 1983*

* Father or mother born, registered, naturalised or adopted in the UK before your birth, which occurred outside the UK on or after 01 Jan 1983*

* A citizen or the UK and colonies at birth and with a grandparent born, registered, naturalised or adopted in the UK*

* A citizen of the UK and Colonies who was ordinarily resident in the UK for a continuous period of 5 years before 01 Jan 1983 and was settled in the UK at the end of that period*

* A Commonwealth citizen whose mother was born in the UK*

* A female Commonwealth citizen who is, or has been, married to a man with right of abode at any time before 31 Dec 1982 *

* A citizen of the UK and Colonies woman who is, or has been married to a man with right of abode at any time before 31 Dec 1982


Can I get your advice / help on this regard, Please. Appreciate any help / pointers on this regards aswell.

As UK-born baby is also automatically British, a CoE-RoA is possible.

So to confirm - Is it that, I just need to choose the option '* Born in the UK after 01 Jan 1983 ' for the 'Right of Abode' online section & during submission provide my original ILR Biometrics card.

Also May I know if any one in this forum has successfully applied for 'RoA' application outside of UK - for a scenario similar to mine ('RoA' outside UK application- for baby born in UK for ILR father). If so, May I get help / advice on the documents check-list or cover letter sample pointers if any.
