Hi guys,
I just found out today that my tier 2 extension was refused on 17th of Nov. Reason being I didn’t get the 20 salary points. Because SOC code I used (2122 mechanical engineering) requires an experienced pay rate of £32,900 and a new entrant pay of £27,100 and for my role I applied for titled, Analytics and reporting engineering, my annual pay would have been £28,550.
Now this comfortably qualifies for new entrant but doesn’t qualify for experienced which explains why home office rejected my application as they think I come under experienced.
However, according to my employer, I still fall under new entrant for 1 more year. This is because my previous tier 2 *general* visa was for two years and this extension application was for ONLY 1 more year. Apparently under tier 2 general rules, you can be sponsored up to three years as a new entrant. After this one year, I would have to move to experience pay rate. Also I was aged 25 at the date of my application if that also counts which is also one of the parameters for a new entrant if that makes any difference.
So my question is in this case who is right? and what option should I pursue: administrative review or new application with a different SOC code that fits the bill/upgraded pay?
This is pretty urgent and we are all working towards a solution right now. We will decide in the next 24/48 hours max after consulting with our immigration officer and her own ‘expert’ colleagues from other firms. I have 9 days left to do an AR.
But i’d like to know what this lovely community thinks? I really need your help! I have worked too hard in the last two years on my graduate programme for this to derail my efforts.
