Right of abode commonwealth citizen

Post by TANTAN » Mon Nov 21, 2016 11:03 pm

Hello I need help please?
My dad was born in 1942 in Jamaica and came to live in the UK in 1961 he died in 2010. Jamaica became independent in 1962 and I was born in 1974 in Jamaica. Even after Jamaica got independence my dad still lived in the UK for more than 10 years - my 2 older brothers were born here. As proof that he's my dad, I have his British passport from 1961, his birth certificate and my birth certificate(with my dad's name on it) also his pension papers. Do I meet the requirements for ROA?

Many thanks!

Unfortunately, I don't think so. Unless you satisfy 2(1)(b).

Did you click Vinny's blue links?

2.1
(b)he is a Commonwealth citizen who—
(i)immediately before the commencement of the M1British Nationality Act 1981 was a Commonwealth citizen having the right of abode in the United Kingdom by virtue of section 2(1)(d) or section 2(2) of this Act as then in force; and
(ii)has not ceased to be a Commonwealth citizen in the meanwhile.
