I am going to apply for ILR under 5 year Tier 2 (General) route in March 2017 and then naturalisation in 2018.
In December 2010 I got a PCN/Parking Ticket for Bus Lane Contravention which was issued by the council, and which I paid immediately on receipt of notice. Touch wood, I have not got any PCNs pr FPNs since.
In Feb 2012 I applied for 1st T2(G) from Post Study Work and in Feb 2015 I applied for further extension for 3 years until March 2018.
In both these applications I did not declare the PCN as it not a court conviction as I was advised and form states that "You must give details of all spent and unspent criminal convictions. This includes road traffic offences but not fixed penalty notices (such as speeding or parking tickets)".
The current SET(O) form also states that "You must give details of all criminal convictions, including spent convictions. This includes convictions for road traffic offences, including drink-driving offences, but not fixed penalty notices (such as speeding or parking tickets)."
Should I declare it on my ILR application. If YES, where should I declare it??
The current Form AN states that:
You must give details of all criminal convictions. This includes road traffic offences (including all drink driving offences).
Fixed Penalty Notices (such as speeding or parking tickets) do not form part of a person’s criminal record and will not be considered in the caseworker’s assessment of character unless:
• the person has failed to pay and there were criminal proceedings as a result; or
• the person has received numerous fixed penalty notices.
I assume that PCNs should be declared for Naturalisation application. If YES, where should I declare it??
Any expert opinion is much appreciated.
