i am new to this forum , need some advice please if somebody can help with one .
my PR been refused based on documents luck and private health insurance after 6 months wait.
applied as family member of an eea national who came her to uk in 2006 and worked until 2011 , in 2010 when we got married i been issued a 5 years rc card in 2011.
after my partner stopped working in 2011 we took health insurance but not for long as we cancelled it shortly after few months , we didn't need it at the time ( we tough we don't ) , since then we had our first kid in 2012 we applied for british passport for him which we received after our application for it been approved by home office with the evidence of my partner exercised treaty right between 2006 to 2011 that home office took in consideration under eea partner route and all the document showing the employment and no benefit been claimed in between 2006/2011.then that was it we carried on with our life .
then early 2016 we took csi to able me applying for PR , i gathered all paper work for it then send it after 6 months wait i received refusal letter with a right to appeal , the reason stated is that my partner did't exercise treaty right in the last 5 years and dind't show enough evidence for csi as self sufficient and that we provided most of document in copies .basically they stated everything was not enough
my question is , how many times can my partner demonstrate the 5 years treaty right if she was qualified person back to 2006 /2011 the prove we got our kid his british passport in 2013 , does she have to demonstrate another 5 years up to the time when i apply for my PR and the first 5 years when she arrived doesn't count.
if it's the case ?
can i re- apply for another 5 years rc in joint application with eea qp certificate ( eea qualified person certificate ) and how complicated is or it it easy to get it after all ?
and do we need any extra documents for it as we only took the csi started in february this year , and the guidance for eea fm and eea qp showing the need for self sufficient is 3 months csi upon to the time before you apply or 3 months bank statement ( savings ) .
