Dear members,

I wondered if somebody could please advice me. My daughter came from India on 19/10/12 on ILE when she was 15. She went back on 11/11/12 to complete her year 11. She came again in the month of May 2013 for a month and went back in June 2013 and then finally came to UK on 17/08/13 for good and joined her sixth form here. My questions are:

1. When can she apply for her citizenship? Will 5 years be counted from the date when she originally came on 19/10/12 or from 17/08/13?

2. Her passport expires on 22/12/16 so is the date on her ILE. She will apply for her new passport soon, will she have to apply for NTL if she wants to travel outside the UK?

3. Will she have any problem entering the UK if she does not have NTL and instead carries both passports?

4. Will she have any problems travelling to countries in Europe or if she applies for Schengen visa?

I do not want to spend unnecessarily on her NTL if she can be granted Schengen visa despite an expired date on her ILE and also if she is eligible to apply for her citizenship in 2017.

My spouse and I have British Citizenship.

Any help will be much appreciated.

1) Apply when requirements are met in full.

No 5 year requirement for minors.

If now an adult simply apply section 6(1) BNA absence rules.
Ensure proof of physical presence in UK 5 years before date of application is available.

4) ILE gives no right to travel to Europe.
Schengen visa required for Schengen zone countries. Proof of right to reside in UK will be required.

Regarding No 4 : If my daughter does not apply for NTL when her passport expires next month, will she have any problem in getting Schengen Visa next year to travel to Europe? Will Italian/French consulate create any issue about the expiry date on ILE ?
