Living Together in the Uk.

Post by Les L » Mon Nov 28, 2016 10:27 pm

Hello.

My name is Les and i am a British Citizen. I am not sure that i have posted under the correct heading and i apologise if i have.

My partner, who is a retired Canadian citizen, would like to come to the Uk to reside with me. We met over 1 year ago, online, and have had one 13 day holiday together. She would like to come here for six months in the spring of next year. After the six months are up here and she returns to Canada, how long would she have to wait before she could return to be with me in the Uk again?

Any advice would be appreciated

Six months but it's not advisable to stay the full six months on a visa visa (or waiver) two or three weeks is acceptable. Six months is the validity, not the term.

The visa is for visits, not residency, you need a settlement visa fo that.

Your partner will need to submit evidence of strong ties to her home country to convince the ECO that she won't overstay her visitor visa.

Regarding frequency of visiting the UK, she shouldn't be seen to spend more time here than she is spending in her home country.

Thank you for your replies.

So where would we start regarding her coming here to settle with me.

Nothing is ever easy. It's not like we are going to be a burden on anyone!

In terms of settling, you need to be married or fiance/fiancee with plans to marry within 6 months or else have evidence of 2 years cohabitation as unmarried partners in a durable relationship.

We are currently engaged and are looking to get married in the spring of next year. What would be the next step after we got married?

Basically either have earned £18600 a year for the past six months or have £62,500 in savings for six months or a combination of both.

Apply for Spouse visa, not sure how much it is now but it's about £1500 including the NHS fee.

Where you intend to marry? In the US or the UK?

Let me explain in more detail.

We met online over a year ago. She is a Canadian citizen and i'm British. We live in our respective countries. We have only met once which was a holiday we had in October of this year. She is now back in Canada and i'm here in the Uk. I am in full time employment and she is retired. She would like to come to the Uk in the spring of next year so that we can marry. What visa would she need for the initial visit and how long can she stay before we get married? After we are married i take it we would need a spouse visa? Hope this is more explanatory

1. Apply for a fiance visa in Canada - visa fee currently £1195
https://www.gov.uk/join-family-in-uk/overview

2. Once the visa is issued your fiancee will have 6 months to marry in the UK

3. After the wedding (and before the visa expiry date) your wife will switch to a spouse visa on form FLR(M)
Visa fee - £811 postal application or £1311 if submitted in person at a PSC. + £600 NHS surcharge
https://www.gov.uk/remain-in-uk-family/apply

FLR(M) will grant your wife an initial 2.5 year visa, after which she will need a further 2.5 year extension before qualifying for permanent residence (ILR) at the end of the 5 year period.

Do you have an annual income of £18,600 or have substantial savings to make up any shortfall?

We have savings and i'm in full time work. Do i apply for the fiance visa in Canada, from the Uk, or does my partner?

Your fiancee applies from Canada.

Me again.

How long can my partner stay in the Uk without a visa?

She is a Canadian citizen?

Visit visa allows six month validity but if you read here, you will see the UKVI applies a stricter code, visit means 2/3 weeks a few times in the period, that's how it was 'designed'. The key is VISIT, the full six months is not a visit, it;s residing and I'm afraid it's been abused by others and hence the wary eye on it now.

If the plan is to marry you shouldn't be penalised at the time but questions may be asked and it's never best to start your visa journey by pushing it on day one.
