What are my chances

Post by Anu4real » Wed Nov 30, 2016 3:42 pm

Came in on a student visa, which expired in oct 2011, i changed my course and wrote exams in September with results due out ib December, so school could not give me a cas letter since they/me could not show progression for the next stage, was told to get permission from home office for them to issue me a CAS lettter, met a lawyer who advised that we write to the home office which we did, got a letter with reference number to say they will consider the request and get back to me, lost my job in 2012, by 2013 june my wife took our daughter and left me (no papers and i could not work, so started to cheat and look for other options to get her papers) ex logged in an application for domestic violence even though there was none (and i brought her in as my dependent) august 2013 i got another letter from home office saying they would try and reach a decision soon, since then till now have not heard from them, first forward nov 2013 my ex leaves our daughter at home alone to go and work ( from around 5am to 10.35pm) neighbour called the police and daughter was taken into care, all this time i was calling and txtimg daily begging to see my daughter but ex refused, after she was arrested for child neglect ex told police and social services that i had abandoned her and our daughter and never reached out to them and that i kicked them out of the house, all this time i was still reaching out to her and still begging to see our daughter, lucky for me behind her, her lawyer reached out to me to inform me of what was going on and the need to get my daughter out of social care, long story short, we went to court and i was able to prove that ex was telling lies about all the allegations she levelled against me, but because i did not have papers and not housing or income (things that could prevent me getting my daughter) my mum who is british was included in the care plan and so a court order was granted to me and my mum to have custody of my daughter, my daughter has since then gotten her British passport due to my mum, am in the process of applying for flr fp due to my British daughter, my mum is 79 and so cant handle the day to day upkeep of my daughter, secondly we all live together, one of the orders made by the court and the council has since then given the 3 of us a bigger place, she only gets to see her mum, once every 2 weeks for 2 hours, i am primarily her main carer, my mum and two older siblings are British and both are settled in the uk with their family, i no longer have an extended family where i am from, since there is no longer any in country appeal, i want to be sure this is the best route for me before i make my application

If you repost this laid out in paragraphs you have more chance of someone reading your story.
I gave up.

Quite a long story, I agree with my colleague that it is too long.

As you have custody over a British jointly with your mother, then yes you may apply for residency.

I feel sorry for the mother. She probably did not mean harm, was probably going to work to provide for the kid. She should have sought help. Such a paradoxical situation.
