Category B Spouse Visa Financial Requirment Query

Dear All
 
Your expert advice much appreciated on my query. Actually i worked in Kazakhstan from June 2016 to Mid Sep 2016 for four months and earned £31000. My monthly Gross salary was £8500 then I come back  to UK on 8th Oct 2016 and now I am starting a new  permanent job from 5th Dec 2016 and my salary for this job is £45000. Please advice that do I fulfil  financial requirement of £18600 to extend my wife spouse visa. And which category I can tick in my wife spouse FLRM application i.e Category B OR A. I did not work before from Jan 2016 to May 2016 this year.
 
Your help welcome please.

The earnings outside of the UK would only have qualified if they had covered the 6 month period prior to submitting the spouse visa application and you had a confirmed job offer to start within 3 months of arrival in the UK, again meeting the £18,600 minimum earnings level.

The overseas earnings will fall short by 2 months.

You will need to wait until you have 6 months payslips + the 6 months corresponding bank statements before submitting your wife's spouse visa application.
(Casa, not CR001)

Thanks for your reply and kind advice. Actually my wife spouse visa will expire on 4th Jan 2017 and please advice how can I wait further for two months for to cover this shortfall of two months payslips. Can I apply my wife spouse visa after 28 days of expiry please and on that case I can complete two months payslip shortfall.

Ah! I wrongly assumed that you were applying for your wife's initial spouse settlement visa.

In which case, don't let your wife's current visa expire. Wait for advise from others better placed to advise on the right income category to apply under.

Do you and your wife have savings? Is your wife working?

The financial requirement under CAT A or CAT B is not applicable.

Is your wife at work or do you have children?

Me and my wife do not have savings and also my wife is not working and we have two British children age 6 months and 7 years. Please advice which option for my wife spouse extension visa is best

Perhaps you will have to place reliance on Family and private life application, rather than on the FLR(M).

Please advice can my wife apply as parent of two British children age 6 months and age 7 year and which application form will be used and please which route she need to choose five year or ten year route. Please advice which is the best option now for my wife to stay further after 4th Jan 2017 spouse visa expiry as I am not fulfilling the FLRM maintenance condition.

No you wife is not allowed to apply as Parents, as she is in a relationship with you.

Hi Obie

So my wife only apply as family life as partner of me and FLR FP form will be used. Please advice. But which route she needs to choose 5 or 10 year route as Family support or income support I can provide to her and also her English test IELETS is expired now which she used for previous successful spouse application. Can she used this expired English test for this five year route for family life as partner?

And other question you asked me saving yes I have saving for four months of £31000.
