Is a Schengen visa required in this case? Help please

Post by KM0170 » Tue Dec 06, 2016 12:47 am

Hi there everyone!

I am a British national with a British passport and am married to my wife who is a Pakistani national who has a spouse visa. We are wanting to travel to Spain for a few days for tourism purposes. We have in the past applied for a Schengen Visa when visiting a European country however it has caught my attention that we do not require one as per the EU directive 2004/38/EC.

Can you please confirm this is the case and provide as much information as possible please?

Thank you

You may be able to invoke the Directive and manage to cross Spanish border but with some stress, delay and questioning.
See https://eumovement.wordpress.com/2010/0 ... to-travel/

:!: But you probably won't get aboard a plane in first place; an airline may not board you without a valid visa or at least an EEA RC (which you won't have).

Why take on all that hassle when on a carefree holiday trip?!
Get a Schengen visa.

Unclear how you will persuade airline to permit wife to board plane.

Either fogret it or take your chances if there is a time constraint.

Your wife need a visa for a family member of a eu citizen anyway.
The question is if she get it from the spanish embassy or from the spanish border post if you both can it make to the border.
There is no simple entry stamp like in the UK for such a entry.

This is serious advice.
So make a Plan B: drive
Or Plan C: postpone/cancel

You haven't much time to waste repesting the question or agonising over it.
