Company Acquisition and Intra-Company Transfer

Hi,

I work for a small firm in Canada which may be acquired by one of the big four accounting firms in a few months' time and I would like to know what bearing this has on my candidacy for a Tier 2 intra company transfer

I realize I need 12 months of continuous employment with my employer in Canada to be eligible for an intra company transfer to the UK however I'm wondering whether the clock will reset to zero following the acquisition. I would like to know if there's a chance I can be transferred to London if we join a global firm without having to start another full 12 months with them.

In Canada, pre-acquisition work may be applied to the 12 month threshold provided you're working in a similar capacity in a similar industry before and post acquisition. However, I don't know if this is the case in the UK.

Any information or resources would be greatly appreciated!

As long as you have been working for the original company for 12 months or more when it is merged, taken over etc you can transfer over under ICT. The legal entity you are currently working even if it is merged and disappears under restructuring etc still keeps the clock ticking. It just becomes messy with the documents in order to prove you worked for X for Y months before it became Z under new structure G as an example.
Almost certainly need a affidavit from a trusted legal source if it become so messy you can't explain it in a single paragraph.
