New rule from 1st December under section 62 - help

Hi so I read about the new rules that have come into force form 1st of December 2016 and wondering if anyone can shed some light please.

The rule I'm referring to is this;

Provisions coming into force on 1st December 2016
5. The following provisions of the 2016 Act come into force on 1st December 2016

(g)section 62 (power to cancel leave extended under section 3C of the Immigration Act 1971)

Our situation is as follows;

My husbands application was refused due to alleged toeic deception, human rights claim refused also despite having small child saying he would be fine should be have to return to his original country. We have appealed to the first tier tribunal and awaiting court date. Are we likely to be affected by the new rule? Also just to clarify according to the new rule could he be deported despite his ongoing case if they felt there was any reason to?

Anyone with any recent toeic appeal experience please do let us know how you have got on. We have no idea what to expect.
