Family Visitor Visa Refused. Banned for 10 years.

Hi Guys,

Hope you all doing well.

Just a quick question if anyone can answer that'll be great.

I'm a British Citizen and my daughter as well. My husband is on a temporary visa.

We have applied for a family visitor visa from India for my mother in law who is a widow. She does have a big family ties her own house and the other son who is working and sponsoring.

We applied first time as we invited her and they refused saying no family ties and showed no income or savings, and the other sons financial documents.

So we applied again second time with everything but accidentally we ticked No on the question where it said have you applied before and we applied in a weeks time, still they refused the application saying you have used Deception to get into U.K.

There was no option or we couldn't found anything to appeal so applied again third time explains everything as it was an error made by us but they still refused the application and said you are banned for 10 years.

Is there anything we can do to fix it?

Please reply if anyone knows anything about it or how to correct it.

Not if you gave a false statement in the application.

She has to convince them that the wrong ticked box was an innocent mistake.

Thank you so much for reply. I really do appreciate it.

The only reason we applied for third is to explain properly and nicely as it was a genuine mistake and completely unintentional. Honest to God but I don't know what to do now?
Is there anyway to get to them without applying for the application so we can just explain?

May be not now but in future if we want her to come and visit us?

Casa Honestly we haven't given them false information. We applied for the first application and it was refused on 27th October saying showed no family ties and property and income. So the second application was applied on 04th November by rushing with the application we missed that question where it said Have you been refused a visa - accidentally we said no on the application form.

They said we have used deception. We clearly explained to them nicely but they still refused without considering the application.

I just want to know how can I get to them to explain them what we did is not to lie or hide anything. We also attached both refusal letters and a covering letter explaining everything.

Any idea anything can be done?

Was their first refusal letter, or a covering letter related to it, also attached when making the second application? Did the second application refer to the previous refusal in any way, to make it clear that there was a previous refusal?

We haven't mentioned anything in the second application about the first refusal but we have attached the first invitation letter sent by us that was by post included in the previous application and second one sent by email saying we will taking responsibility of arrival and departure from U.K.

We have attached the first refusal letter with the application but it was taken it off by the official when they accepted the application.

I don't know if it helps. They might turn around and say you are lying.

In regards to first application we have given all the related documents but it was taken off by the application accepting official saying it was not in application.

That's a pity. If the refusal letter of the first application was left alone in the second application as you had intended, then it would have supported your contention that there was no intention to deceive. The staff member should have left it in place! S/he really had no authority nor business to remove an applicant's documents. If s/he can confirm to the ECO that s/he had removed it for some reasons of her/his own, then it may go a long way to show that there had been no intention to deceive on your part and the wrongly ticked box was an innocent mistake.

Typically, an application following a refusal would normally explicitly address the grounds for the previous refusal, making it obvious that there had been a previous refusal.
