Need Help Plz EUFAM NON EU dependent

Post by Malik10991 » Mon Dec 12, 2016 3:14 pm

Hi All,
I am currently 26 years old came as a visitor to UK when i was 17. long story cut short I did applied for a Leave to remain in UK but was unsuccessful. Well now I traveled with my father( a British National)from UK to Ireland. Since i came here in august 2016 my father started his company of which he is a director of and is also getting paid by his own company. opened a company account etc. whereas i have since than started a year long course at college.
the question is Now my father wants to file a case for my settlement what docs are needed?
1) For a company director? i.e does he needs the payslip or would he send the business invoices instead?
2) "HOW TO PROVE THAT I AM HIS DEPENDENT".
3)would my UK immigration history be a problem i.e would Irish authorities check the previous immigration history?
the list of documents we have:
1) PRTB
2) Bills in our names
3) My father's and my Bank accounts
4) Letter from the college that i am a student
5) Birth certificate Atessted and Translated
6) Valid passport
Kindly guide me as i am totally confused :?
thanks for your help

Settlement on what basis? Irish law or EU law?

In the meantime...
1) Depends on domestic requirements or EU requirements. Which one is it?

2) Are you dependent on kindly father? How?

In the EU context, prove by submitting a rock-solid papertrail of documentary supporting evidence.
Proof of dependence for essential daily needs (food, accommodation).
Plus proof of relationship ofcourse.

3) The two neighbours and governments routinely share immigration intelligence as they are part of CTA.

Hi thanks for the reply
Settlement on the basis of eu law. Treaty rights of an eu national.
Dependent on the father as i came to UK in 2008 and lived with my father since then. Plus me and my father are living in the same house in Ireland and my father regularly transfers money into my account.
So it's not at all fabricated in anyway I really am depending on my father well technically I was a visitor and no visitors are allowed to work and my father has been providing for me since then.
So kindly reply in the context with eu law.
Regards

You are not a 'visitor'.
To be able to live in Eire under EU rules, after the first 3 months, you need to be sponsored by a Union citizen who is a qualified person (father);
so yes, you have to be able to show dependency on sponsor in order to reside and study or even work.

As for Irish specifics check INIS; I only know details for UK in detail.
You may even have acquired PR status by now.

Could you please elaborate this point.
I do appreciate your patience and perseverance but I want to be safe than sorry.
I was reading through the ec law book on pg 14 it says report presence shall we go to the police station and do it and do we do it now or after filing the case?
And kindly clarify that if me and my dad live at the same address and he regularly transfers money into my account from his acc would that be sufficient to prove me as his dependant? Or could I add in some extra evidence if yes then any examples like what could be added?

HI

you can apply EU residence card in Ireland,

you need

Birth Certificate to prove your relationship

Dependency documents e.g bank account or money transfer receipts etc

also you can provide documents showing same address in the UK.

Your father must be working, sefl emp, study , etc in Ireland.

What is that law book you are referring to?

I mean you will have to dig into INIS website for the nitty gritty as I don't know about Irish-specific details.

Yes, financial evidence of dependency would be a good start.

HI Malik

Thanks for reply my father is currently self employed he is a company director. would he send all of his company sales receipts or would two of his recent payslips suffice?
I already have Passport, Birth Certificate( attested and translated), Bank Account statements, Bill, and prtb.
Is there any additional info i could attach?

Thanks :)

Proof of dependency will be needed.
