Move to Germany with non eea spouse

Move to Germany with non eea spouse

Hi ppl !

The Germany Embassy website can't cover my scenario, I guess.

Me: Hungarian/Brazilian
He: Brazilian
Our 2 kids: just like me

We live in UK actually. We are considering to move to Germany (brexit feelings)

They say things about family reunification, where looks like I supposed to be there already - and our plans is to go together as family, I mean: we will take the very same airplane.

I may face some difficulty to find a job, but my husband...well, there is a good chance for him to arrive in Germany already with a job because he is an IT developer and almost every week someone from Germany offers a job.

I'm not sure if Germany is like UK. in UK in order to apply for a residence card, the EEA sponsor MUST have a job and the non-eea must wait at least the Acknowledge letter arrive.

So, how can someone explain me how to move out to Germany with a family together including a non-eea spouse ?

ty ! I appreciate, but almost everything I read already in different sources.
This still can't cover my scenario. In theory (according with euurope.eu) , my husband can work in the very moment he steps in Germany or UK. at least in UK: try to find a job without a RC to see what's happen ;)

That's the reason I prefer to have conversation and humans orientations. Don't be upset with me.

You want to live and work in Germany, that's not so special nor difficult.

Its the same system in Germany or UK, all covered by EU law.
Whether employers know that or care or follow that (in either country) is out of your control.

And you and hubby don't have to work, you could be selfemployed or even selfsufficient (or even studying in the wonderful and free German universities).

When you get to Germany simply get with their programme.

In short:

1. Husband applies for short term Schengen visa under EU rules
2. You all move to Germany and register your residence with the local municipality
3. Ideally, you as the EEA spouse finds a job of at least 16 hours/week
4. With first payslip in hand as proof of exercising treaty rights, RC application for your husband should be a doddle and if not a same day decision, then usually no more than a few weeks.


Yes, he CAN work from day one. Good luck convincing a prospective employer.

Yes, he CAN apply for RC while you are a jobseeker. BUT it seems like most of those applications are simply kept until 90 days since your arrival in the country have passed and the alien department then requests documents to show that you are exercising treaty rights, have German health insurance since the day you registered, etc., etc.

Easiest on many levels would really be for you to get a job, any job before applying.

You can apply as self-sufficient but I have no official information on how this is calculated. I have heard of cases where the case worker asked for savings equal to the German minimum subsistence level for five years (RC validity), as this would be for your whole household = 3 persons, this is a lot of money.

Excellent, thank you for pointing this out! I had thought of checking but then was distracted by my grocery delivery.

Only one thing to note: in that case convincing an employer that it is legal for the OP's husband to work will be even more difficult.
