Government will cut off my husband benefits

Post by AkbarHaf » Mon Dec 19, 2016 4:48 am

Hi everyone
I have a little question or we can say problem
I'm now in uk with a spouse visa, my husband is getting benefits from government cause of his disability.
I found a job here which I'll start working soon
But the point is the government will cut off all or part of his benefits.
Plus I'm still looking forward the next visa, if they stop his benefits, how can he support and sponsor me in my next stage of visa!
How and what can you advise me please

I can't answer your question about the reduction in benefits as this isn't an immigration matter. However, when it comes time to apply for your first FLR(M) extension you will be able to include your earnings in the £18,600 calculation.

Are you talking about your husband not having to meet the 18.6 to sponsor you as he is on DLA, or on it's replacement PIP?

DLA/PIP are in work benefits and are not income based benefits. You working will not stop these benefits. It's him being found fit enough to not need DLA/PIP that will stop these.

If he also claimed income based ESA as he didn't work AND is in the WRAG (work related group of ESA) and therefore has to go to the job centre to prepare for work, then yes, you working does mean that his ESA is reduced or ends as your income is counted for income based benefits. Contribution based ESA and in the WRAG, only protects him for 1 year and after that he moves onto income based ESA and your income is counted then.

If he is stil on DLA or PIP when you go for your next visa, then you don't have to meet the 18.6 and I am assuming that your salary can be used to meet the adequate maintenance? If he isn't on DLA/PIP then, as Casa said, your salary and his salary can be used to meet the 18.6 to sponsor you.

Thank you so much for your reply
Yes he's getting DLA & ESA
I was planning to work part time, like 20 hours a week.
But the point is they gon reduce his ESA to more than half.
Plus he will be imposed upon to pay rent and doctors as well. Which he was exempted to pay before.
is that true?
I did ask in citizen advice center, they said if I work all of his benefits will affect, except his DLA, even if I work part time only ?
Is that true?
Can you please help me

Suggest contact CAB for tailored advice and/or your local community law centre / benefits advice centre / migrant support centre.

You should also consider that the benefit system in the UK is for those who are on a low income. If you earnings are of a level considered sufficient to support you both, then the benefits will be adjusted accordingly. This is the same for all.

As noajthan has advised, seek advice from the relevant departments.

So I can work then ! But how many hours are allowed for me without touching his benefits?
And how much is the low wages level people can get safely

Seek advice as suggested by noajthan. No one on the forum can tell you with any certainty what benefits your husband will be entitled to.
