Tier 1 entrepreneur visa Dependants

I came to the UK 7 years ago in 12/2009 on tier 4 visa after that I extended my visa on tier 4 and 2 categories. After my tier 2 sponsors license revoked, I applied for Tier 1 entrepreneur visa before expiration of 60 days curtailment letter. I wanted advice on two issues:
1) I have two children 9 and 4 years old. When I applied the application for tier 1 visa, my consultant advised me not to apply for the 4 years old now, wait for the result and after that put forward his file. Recently, they received email from the home office enquiring about the minors whereabout. Please advice me does this effect result on the visa.
2) If in case I got negative result for any other reasons does I accounted as an over stayer. Then, should I go for appeal or put a fresh application.
