Tier2 dependent visa expired when Tier2 main resigns the job

Post by Semi » Tue Dec 20, 2016 8:57 am

Hello
I am working in UK as a Tier 2 visa dependent.
(My husband has a Tier 2 main visa)
Our visa will be expired August 2017.
I have two questions.

1) If my husband quits the job before August 2017,
can I still work in UK as a Tier 2 visa dependent by August 2017?
Or will my visa be expired as soon as my husband resigns?

2) If my husband works by August 2017 when our visa is expired,
when should we leave UK? Before visa expired? Or is there any flexibility?

Thanks!

1) You can continue working as long as your husband's leave has not been curtailed by UKVI if he resigns. If the leave to remain is curtailed in the event of resignation, then your leave to remain will be curtailed as well to be aligned with your husband.

2) You should leave before the expiry of your visa to avoid having complex visa applications in future. You will be over stayer if you leave UK after you leave has expired. Also, you are not allowed to work at all after your leave has expired and you have not submitted any application for visa extension.

Thanks,
