Mccarthy Cases (Transitional Arrangements 2012)

Dear Noajthan.

Very Good Morning to you.

Would you please kindly through some light as how to invoke the Mccarthy Cases (Transitional Arrangements 2012) in the letter when we send the PR Application for an EEA-Family Member after 5 Years.

Also, if you can please if you can confirm if these transitional arrangements are still in place.

Also, if the Online PR-Application is available only for EEA Nationals and not for the EEA-Family Members?


I would second the other lady mentioning ‘’you have to be a writer’’ if you are not.

I am always reading your answers where you use lots of phrases, sentences, words , they might sound like biting sometimes but certainly make you laugh when you realise and understand and this is my honest compliment.

Yes, EEA Regulations and McCarthy ta are still in place.

If McCarthy ta applies then simply point out that fact in a cogent letter, based upon and describing the following pertinent facts of your case:
  • dates present in UK - both parties;
    sponsor's status - at relevant date;
    marital status - at relevant date and since then;
    possession of FP or RC by critical date;
Also refer to the ta itself!
