b1/b2 visit visa maximum stay

Post by rg808253 » Wed Dec 21, 2016 9:22 pm

Hello there

My mother got 5 year multiple us visa, upon entry nothing is stated on her passport.

Now she is coming back after 2 days less than 6 months but staying there 182 days.

it is very confusing that what is the maximum stay on visit visa is it 6 months or 180 days??

thanks in advance

in addition i want to add couple of things in my first question.

My mother got 5 year multiple usa visa she is pakistani national, upon her first entry in 2015 entry po officer put 6 months permission on her passport. but this year they did not put any stay limit on her passport on entry.

Now this year 2016 she is coming back after 2 days less than 6 months stay, but staying there 182 days.

it is very confusing that what is the maximum stay on visit visa is it 6 months or 180 days??

thanks in advance

Patience is a virtue in immigration matters.

if you wish for faster response suggest hire a paid professional if you can find one willing to leave their <insert comfort/relaxation of choice> during this holiday season.

While it's true that you are normally permitted to enter the US for up to 6 months on a B1/B2 visa, the actual number of days you are permitted to stay for a given visit is what's recorded on your electronic i94 record, by the Immigration Officer at the Port of Entry. They would ask you how long you are visiting for and then enter the number of days based on that on the system. If she wants she can check how long she was admitted for during her last visit by checking her i94 record online. The website to do this is given below:

https://i94.cbp.dhs.gov/I94/#/home

When I've visited the US on a B1/B2 visa in the past, the number of days I was admitted for has never been entered on my passport. It's all captured electronically; I've seen when I've checked my i94 records, that even when visiting for a few days they've admitted me for a period much longer than that - never more than 6 months though. If you stay beyond what's recorded on your i94 record you would be considered to have overstayed.
