Applying for EEA FP shortly after marriage

Post by 696969 » Fri Dec 23, 2016 8:16 am

Hi

I’m wanting to apply for an EEA FP to join my same-sex EEA national partner (soon to be wife) in the UK. I have a few questions regarding our application.

Quick overview of our situation:
-We met and entered a relationship in the UK in June 2016. Over the next few months we decided we would get married as it would be the fastest way for me to rejoin her in the UK as my visa was due to end in Nov 2016. I left the UK in Nov and we are continuing our relationship long distance until she can come to me in NZ to get married in March 2017. We have not lived together thus far although intend to upon my return to the UK.

Considering by the time she arrives in NZ and we get married, we will have been apart from each other for four months and will be very eager to get the application sent off for the EEA FP as soon as possible so I can quickly join her in the UK without the hassle of distance continuing.
Is it going to look bad on our application if we apply very soon after our marriage (within days perhaps), especially considering we have been together for less than one year. We do not want to lie on the application about when we met etc, as we are in a genuine, committed relationship and don’t want to risk refusal on the grounds of a suspected marriage of convenience. Are there any extra supporting documents I should provide to help prove our relationship is legitimate? I plan to include

-Her passport, my passport + copies
-Proof of exercising treaty rights (payslips for the last year, employment agreement) + copies
-Marriage certificate + copy
-Her council tax, utility bills, water/gas bills in her name - Is this enough? As she’s been renting the same flat for so long the landlord never bothered to renew the tenancy agreement so she doesn’t have one.

For proof of genuine relationship, should I also include the following?
-Letter by her to confirm the relationship and to request the permit so I can join her in the UK.
-Her plane tickets to visit me for our wedding
-Screenshots of messages/skype conversations/emails to show our contact while we’ve been apart (how many of these should I include?)
Anything else?

Any information would be greatly appreciated as we really don’t want to miss anything out.

Thanks

Send as much evidence of relationship as possible:
papertrail; generate ongoing one if necessary;
tasteful photos;
any joint paperwork relating to life together and/or wedding planning etc.

Sort out that house contract too.
You need to engineer your lives to generate unimpeachable papertrail.

Be aware you may be refused first time (even longmarried couples can be);
forewarned is forearmed.

Have wonderful wedding day.
