I need your help please for settlement visa

Dear All,

I need your help and your advise.

I have put UK visa settlement visa application and I have applied from Pakistan on 01 May 2016 and I got refused on 17 August 2016.

The ECM refused me based 'Financial Requirements' as below points all other point were met the requirements.
1st point:The employer and the sponsor both said that the sponsor (my wife) works from Monday to Saturday. The business website states that the takeaway is closed on Tuesday.
My statement: The home office called both my wife and the employer on 24 of July 2016 and the employer decided to close the takeaway from 01 August 2016 which was one week after the call from the home office and neither we had the phone number of the caseworker to update him accordingly as when they are calling the number is coming UNKNOWN number.

2nd point: The employer said that the sponsor is paid cash in hand whereas the sponsor said that her wages are paid directly to her bank account.
My statement: My wife has 2 jobs the first job she is working in nursery as child care which she receives her wages directly to her bank account where her 2nd job she is working in takeaway as customer assistant and she receives her wages in cash in hand. Actually my wife said correctly but the ECM did mistake or he misunderstood and we have requested to check the call record.

3rd point: The employer stated that his business is a limited company. Searches on records held by companies house show no record of a company called Yxxxx Burger Bar on anything similar.
My statement: the ECM searched with the wrong name Yxxxx Burger Bar where the correct name is Yxxx Burger and Sxxxx Bar.

I have reviewed my case and I have submitted the appeal ground with the evidence against above point on 01 Sepetember 2016 and on 19 of December I received the information that the ECM didn't changed his decision.

I have full evidence for the above points as all the mistakes done by ECM himself.

Now my case is going to the court and I know it will take longer time.

I need from you all to advise that Should I submit a fresh a application or need to wait for the court?

Probably better to re-apply and ensure all reasons for refusal are covered in the new application.

Do bear in mind that all 'cash in hand' wages must be paid into the bank by the sponsor in order to submit a paper trail of evidence.
