Tier 2 General CoS allocation

Post by jayacharm » Fri Jan 06, 2017 5:48 pm

Dear Gurus,

Please help me with this. My spouse is going to apply for his Tier 2 general extension in February. As per his initial contract the employer has assigned a CoS up until 02/2018 initially, but due to the approval of additional funding after this, they can now extend the contract up till 02/2019. Since the CoS is already assigned, what options do we have in order to apply for 2 years extension instead of the 1 year that has already been allocated in the CoS.
1. Can the employer discard the former CoS and issue a new one for two years or can they only amend the former to include the time length changes?
2. Does having amendments in the CoS affect the straight-forwardness of the application?
3. Also, the RLMT conducted three years ago offered him the contract till 02/2018. Does having a CoS now extending the contract to further more year than the contracted length is allowed under an extension without a new RLMT? (It is under the same SoC and the same employer and salary requirements are met)

Your help is much appreciated. Thank you.

3. Should not be an issue as long as the SOC is same and salary is above the level expected. New RLMT not required.
Cant answer 1 and 2
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

1. yes. they can issue new cos. they cant amend old one, they can only add notes. However, sometimes the notes are overlooked and visa is granted as per the dates mentioned in the cos. best to get a new cos.
2. no.
3. if same employer and same job, no rlmt needed.
